Al Hassan is charged with war crimes and crimes against humanity committed in Timbuktu, Mali, between 1 April 2012 and 28 January 2013. He is in the Court's custody. His trial is scheduled to start on 14 July 2020.

Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud, Alleged member of Ansar Eddine and de facto chief of Islamic police, is allegedly responsible for war crimes and crimes against humanity committed in Timbuktu, Mali, in the context of a widespread and systematic attack by armed groups Ansar Eddine/Al Qaeda in the Islamic Maghreb against the civilian population of Timbuktu and its region, between 1 April 2012 and 28 January 2013. On 27 March 2018, the ICC issued an arrest warrant against him. He is in the Court's custody. On 30 September 2019, Pre-Trial Chamber I issued a confidential decision confirming the charges of war crimes and crimes against humanity. On 21 November 2019, Trial Chamber X was constituted and will be responsible for conducting the trial, scheduled to start on 14 July 2020.
Charges: 

On 31 March 2018, Mr. Al Hassan was surrendered to the ICC on charges of crimes against humanity allegedly committed in Timbuktu, Mali, in the context of a widespread and systematic attack by armed groups Ansar Eddine/Al Qaeda in the Islamic Maghreb against the civilian population of Timbuktu and its region, between 1 April 2012 and 28 January 2013 -Torture, rape, sexual slavery, other inhumane acts, including, inter alia, forced marriages, persecution - and of war crimes allegedly committed in Timbuktu, Mali, in the context of an armed conflict not of an international nature occurring in the same period between April 2012 and January 2013 -Torture, cruel treatment, outrages upon personal dignity, passing of sentences without previous judgement pronounced by a regularly constituted court affording all judicial guarantees which are generally recognized as indispensable, intentionally directing attacks against buildings dedicated to religion and historic monuments, rape and sexual slavery. The surrender follows an arrest warrant issued by Pre-Trial Chamber I on 27 March 2018.

 

 

Victims: 

The Chamber has authorised over 880 victims to participate in the proceedings. They are represented by their legal representatives, Mr. Seydou Doumbia, Mr. Mayombo Kassongo and Mr. Fidel Luvengika Nsita, appointed by the Chamber on 20 March 2019 and authorised by it to present the views and concerns of the victims. They do so particularly through written and oral submissions on behalf of the victims, since the latter in principle do not appear physically in the courtroom.

On 21 November 2019, a trial chamber responsible for conducting the trial phase has been constituted. That chamber will set inter alia the modalities of victims' participation at trial. Meanwhile, the Victims Participation and Reparations Section (VPRS) continues to collect and accept application forms from victims.
