SUMMARY DAY TWO

ASP22 continues with election of two ICC judges 

22nd session of the Assembly of States Parties 2023, United Nations Headquarters, New York, U.S.

The second day of the 22nd session of the Assembly of States Parties (ASP) to the Rome Statute of the International Criminal Court (ICC) continued with the ICC Judicial elections. On day one, the Assembly elected two judges, Mr. Erdenebalsuren Damdin (Mongolia) and Ms. Iulia Antoanella Motoc (Romania).  Day two continued with rounds three through eight of elections.  

Third Round 

During the third round of voting, no candidates were elected, as no candidate received the required 2/3rd majority votes of ICC states parties present and voting (116) to be elected. Following the third round, states were left with a minimum voting requirement (MVR) for one candidate from Asia Pacific, one candidate from Eastern Europe and two male candidates. MVRs are instructions that States Parties must follow when filling out ballot papers for their choice of candidates to fill judicial vacancies, which seek to ensure the preservation of the balance dictated by the Rome Statute for the bench concerning gender, regional representation, and type of competence requirements.   

Fourth Round 

During the fourth round of voting, no candidates were elected, as no candidate received the required 2/3rd majority votes of ICC states parties present and voting (121) to be elected. Following the fourth round, states were left with a minimum voting requirement (MVR) for one candidate from Asia Pacific, one candidate from Eastern Europe and two male candidates.  

The fourth round was the last round in which states parties had to vote in accordance with the Minimum Voting Requirements (MVRs) for this election which are one candidate from List A; one candidate from List B; two candidates from the Asia-Pacific group; two candidates from the Eastern European group, and three male candidates. 

Following the reading of the results for the fourth round of elections, Burkina Faso announced the withdrawal of their candidate, Adélaïde Dembélé.  

Fifth Round 

The afternoon resumed with the announcement of the fifth round of voting, during which no candidate was elected, as no candidate received the required 2/3rd majority votes of ICC states parties present and voting (123) to be elected.  

Sixth Round 

During the sixth round of voting, Nicolas Guillou (France) was elected, as he received the required 2/3rd majority votes of ICC states parties present and voting (123) to be elected. 

Ahead of the seventh round of voting, North Macedonia announced the withdrawal of their candidate, Mirjana Lazarova Trajkovska

Seventh Round 

During the seventh round of voting, no candidate was elected, as no candidate received the required 2/3rd majority votes of ICC states parties present and voting (120) to be elected. 

Ahead of the seventh round of voting, Germany announced the withdrawal of their candidate, Ute Hohoff

Eighth Round 

During the eighth round of voting, Beti Hohler (Slovenia) was elected, as she received the required 2/3rd majority votes of ICC states parties present and voting (123) to be elected.

The election will resume with the ninth round of voting in the morning of Wednesday 6 December with two judges still to be elected. Six candidates remain on the ballot.  

The Coalition for the ICC has consistently called on states to nominate and elect only the most highly qualified individuals through fair, transparent and merit-based processes. While the Coalition does not endorse or oppose any individual candidates, it strongly opposes reciprocal political agreements (“vote-trading”) in all ICC and ASP elections.
